Are snus and nicotine pouches legal in the Netherlands?
Neither product may be sold in the Netherlands. The NVWA states plainly that there is a ban on placing nicotine pouches on the market, and on snus, the pouches that do contain tobacco. Nicotine pouches were first caught by a 0.035 g nicotine limit under the Commodities Act in November 2021; the cabinet decided on 21 April 2023 to bring all tobacco-free nicotine products under the Tobacco and Smoking Products Act and ban the sale of all nicotine pouches. Dutch customs allow travellers to bring snus or pouches in for their own use only, and ordering them online from abroad risks interception.

Nicotine pouches in the Netherlands
Banned for sale, personal use allowed.
The original rule banned placing on the market any nicotine pouch containing more than 0.035 g (35 mg) of nicotine, which in practice covered every product on sale. The 2023 decision brought tobacco-free nicotine products under the Tobacco and Smoking Products Act, adding a total sales ban plus the advertising ban and the smoke-free-area rules. NVWA enforces actively: 254 inspections and 22 large seizures in 2023. Possession and use by a private person are not offences. The 18 age limit is that for tobacco and related products; it is moot while sale is banned.

The NVWA lists snus alongside nicotine pouches among prohibited products: 'In Nederland geldt een verbod op het in de handel brengen van nicotinezakjes. En ook op snus: zakjes waar wel tabak in zit.' The prohibition is on placing on the market; private possession and use are not criminalised, and customs explicitly permits bringing snus in for own use.

Douane states: 'U mag snus of nicotinezakjes alleen voor eigen gebruik meenemen naar Nederland.' Ordering pouches from a foreign webshop is not a safe route, because the sales ban applies to supply into the Netherlands and parcels can be seized.
