Are snus and nicotine pouches legal in Austria?
Tobacco snus and chewing tobacco may not be placed on the Austrian market: the Tobacco and Non-Smokers Protection Act (TNRSG) prohibits marketing tobacco for oral use, in force since 20 May 2017 under the EU-wide ban. Tobacco-free nicotine pouches are legal and, for the first time, explicitly regulated by the TNRSG amendment published as BGBl. I Nr. 68/2026: sale only to adults aged 18 or over, sale only through licensed tobacconists (Trafiken), an advertising ban, a mail-order ban, extra health warnings and a minimum pack size of 15 units. Possession and personal import of both products for own use are not offences.

Nicotine pouches in Austria
Legal, 18+, tobacconists only (2026 rules).
Pouches were unregulated until the 2026 TNRSG amendment, which for the first time explicitly covers 'tabakfreie Nikotinerzeugnisse, wie Nikotinbeutel, Nikotinzahnstocher oder Nikotin-Schnupfpulver'. Under the new rules pouches carry the advertising ban, may be sold only in licensed tobacconists, may not be sold to under-18s, must carry additional health warnings and must be packed in at least 15 units; the mail-order ban was tightened after enforcement problems. Different provisions have staggered commencement dates and transition periods for stock already on the market, so shop-level practice through 2026 varies. No statutory nicotine cap per pouch was identified.
Tax: No dedicated excise duty on nicotine pouches identified; the products are now inside the tobacco monopoly distribution system.

Tobacco snus in Austria

The ministry lists the TNRSG as containing a 'Verbot des Inverkehrbringens bestimmter Produkte, insbesondere von Tabak zum oralen Gebrauch, Kautabak und Einweg-E-Zigaretten'. Austria is unusual in also banning chewing tobacco. Only Sweden holds the EU derogation; Austria's own accession treaty gave it no such exemption. The prohibition is on placing on the market, so a private supply carried in for own use is not punishable, while commercial trade is.
