Belgium bans the sale of both products. The Royal Decree of 14 March 2023 states simply that it is prohibited to place nicotine pouches and cannabinoid pouches on the market; it applied to wholesalers from 1 July 2023 and to retailers from 1 October 2023. Tobacco snus has been unsellable for longer under the EU oral tobacco ban. Both bans target placing on the market rather than private possession, so using a personal supply is not itself an offence, but no shop in Belgium may sell either product. The tobacco allowance from outside the EU is 250 g for travellers aged 17 or over.

Nicotine pouches in Belgium

Article 2 reads: 'Il est interdit de mettre sur le marché des pochettes de nicotine et des pochettes de cannabinoïde.' The decree was published in the Moniteur belge on 24 March 2023 and took effect for wholesalers on 1 July 2023 and for retailers on 1 October 2023. It was adopted as part of the federal anti-tobacco plan, on the reasoning that pouches look and act like snus, which was already banned. The prohibition covers placing on the market, not private use. Enforcement has been criticised as incomplete, with some retailers continuing to sell.

Tax: No excise duty; the products may not be placed on the Belgian market.

Snus is treated as tobacco for oral use and cannot be placed on the Belgian market, which is the stated reason the 2023 decree extended the same treatment to tobacco-free pouches. Possession and use by a private individual are not criminal offences. The minimum age for tobacco sales in Belgium is 18.

Belgian customs publishes no snus- or pouch-specific allowance.
