Nicotine pouches are legal in Hungary for adults aged 18 or over, but they may be sold only in state-licensed National Tobacco Shops (Nemzeti Dohanybolt), not in supermarkets or online. Government Decree 39/2013 (II. 14.), extended on 25 June 2024 by sections 19/F and 19/G, caps a pouch at 17 mg of nicotine, limits a pack to 20 pouches, requires child-resistant packaging and a health warning on 30% of the two largest surfaces, and obliges manufacturers to notify the chief medical officer six months before launch. Tobacco snus may not be sold at all under the EU oral tobacco ban in Article 17 of Directive 2014/40/EU.

Nicotine pouches in Hungary

Hungarian law calls them 'dohanyzast helyettesito nikotintartalmu termek' (smoking-substitute nicotine product). Maximum 17 mg of nicotine per consumption unit; packs of at most 20 pouches; child-resistant packaging; warning 'Ez a termek nikotint tartalmaz, amely karositja az on egeszseget, es fuggosegehez vezet' on 30% of both largest surfaces in black Helvetica on white. Manufacturers, importers and distributors must notify the national chief medical officer six months before launch, receive a certificate within 60 days, and pay an annual per-brand fee (reported at HUF 570,000). Retail is confined to licensed tobacco shops, which excludes internet sale. Flavours are not restricted.

Tax: No separate published excise rate for tobacco-free nicotine pouches was found; the retail monopoly and registration fee are the main fiscal levers.

Hungary has had to ban the placing of tobacco for oral use on the market since EU accession in 2004. Personal use is not an offence; travellers may carry a personal supply but cannot buy it in Hungary or have it mailed in.

Tax: No retail rate is published because oral tobacco cannot be placed on the market.
