Are snus and nicotine pouches legal in Germany?
Tobacco snus cannot be sold anywhere in Germany: section 11 of the Tobacco Products Act bans placing oral tobacco on the market, implementing the EU-wide ban in force since 1992. Nicotine pouches in Germany
Banned for sale (novel food), legal to use.
Because they contain no tobacco, pouches fall outside the Tobacco Products Act. German authorities instead treat them as food: nicotine is neither authorised as a food nor as a food ingredient under the Novel Food Regulation, so placing them on the market is prohibited. The Hamburg Administrative Court held on 5 March 2021 that the marketing of tobacco-free nicotine pouches is and remains prohibited. Enforcement is a Land competence and varies. Buying, possessing and using pouches is not an offence, and private orders from retailers in other EU states for own use are in practice tolerated. Where a shop does sell them, the Youth Protection Act 18 limit for nicotine products applies.
Tax: Germany's Tobacco Tax Act covers substitute products for smoking (e-liquids and heated tobacco), not oral nicotine pouches; no excise applies because they may not be marketed.

Section 11 TabakerzG reads: 'Es ist verboten, Tabakerzeugnisse zum oralen Gebrauch in den Verkehr zu bringen.' Chewing tobacco remains legal, so enforcement focuses on snus mislabelled as chewing tobacco: the Bavarian LGL examined 144 such products between 2020 and 2025 and classified all of them as prohibited oral tobacco. Private possession and use are not criminalised, and travellers routinely bring snus from Sweden for own use.

The section 11 ban and the novel-food ban both target placing products on the market, not private possession, so bringing a personal supply from Sweden or another EU state is not an offence.
