Are snus and nicotine pouches legal in France?
France bans both products. Tobacco snus has been unsellable since the EU oral tobacco ban, now article L3512-13 of the Public Health Code, which prohibits manufacture, sale and free distribution of oral tobacco in portion pouches. Tobacco-free nicotine pouches went further: décret n° 2025-898 of 5 September 2025 prohibits the production, transport, import, export, possession, offer, transfer, acquisition and use of any oral nicotine product other than medicines, in force from 1 April 2026. The Conseil d'État suspended parts of the decree on 22 December 2025 but left the ban on sale, acquisition and use fully in place.

Nicotine pouches in France
Banned outright since 1 April 2026.
The decree prohibits 'la production, la fabrication, le transport, l'importation, l'exportation, la détention, l'offre, la cession, l'acquisition et l'emploi de produits à usage oral contenant de la nicotine' across the national territory. It covers portion pouches, porous pouches, paste, balls, liquids, chewing gum, lozenges and strips, and exempts medicines, medical devices and chewing tobacco. Entry into force was the first day of the seventh month after publication, i.e. 1 April 2026. On 22 December 2025 the Conseil d'État suspended the provisions on manufacture, production and export pending the merits, but the bans on sale, offer, transfer, acquisition and use remain in force. Unusually, France bans possession and use, not just sale.
Tax: No excise; the products may not be placed on the market at all.

Tobacco snus in France
Banned for sale (EU oral tobacco ban).
Article L3512-13 prohibits the manufacture, sale, distribution and free supply of oral tobacco products in powder or fine-particle form, including portion pouches, with an exception only for tobacco intended to be smoked or chewed. Possession for own use is not itself criminalised by that article, but the 2025 oral nicotine decree explicitly excludes only chewing tobacco, so snus users should treat their position as legally exposed. Distance selling of tobacco to French consumers is prohibited.
