Are snus and nicotine pouches legal in Switzerland?
Switzerland is outside the EU, so the EU oral tobacco ban does not apply and both products are legal. The Tobacco Products Act (TabPG) and its ordinance have applied since 1 October 2024 and expressly cover 'Nikotinprodukte mit oder ohne Tabak zum oralen Gebrauch (Snus, Nikotinbeutel)'. A nationwide minimum age of 18 applies to every product covered by the Act, replacing the patchwork of cantonal age limits. The BAG FAQ confirms that 'Nikotinprodukte mit oder ohne Tabak zum oralen Gebrauch (Snus, Nikotinbeutel)' fall under the Act. Sale to under-18s has been prohibited nationwide since 1 October 2024. Tobacco-free oral nicotine products must carry the Swiss health warnings, unlike tobacco snus which may use the Swedish label layout under the Cassis de Dijon principle. Products must be notified to the BAG via tabacinfo.ch. Advertising is restricted: no outdoor posters visible from public space, none in public transport, public buildings, cinemas or sports venues, and no sponsorship of events with an international or youth audience. No maximum nicotine content per pouch was identified.

Tobacco snus in Switzerland

Switzerland is not an EU or EEA member, so Directive 2014/40/EU Article 17 does not apply and tobacco snus may be sold openly. The TabPG treats snus as a nicotine product for oral use with the same 18 age limit, notification duty and advertising restrictions as other tobacco products. Warning-label placement for tobacco snus follows either the Swiss rule (lower part of the front of the pack) or, via the Cassis de Dijon principle, the Swedish layout on the two largest surfaces.

Switzerland does not publish a snus- or pouch-specific allowance; oral nicotine products count within the general tobacco allowance.
