Are snus and nicotine pouches legal in Spain?

Nicotine pouches in Spain
Legal, unregulated; 0.99 mg cap pending.
Neither Ley 28/2005 nor Real Decreto 579/2017 mentions nicotine pouches; the Ministry of Health itself described them in November 2024 as a product 'not covered by previous regulation'. In practice estancos and most shops apply the 18-year tobacco rule voluntarily. Two measures are pending: (1) a draft Royal Decree amending RD 579/2017 that caps pouches at 0.99 mg nicotine per pouch and bans flavours; it passed first cabinet reading in September 2025 and cleared EU (TRIS) notification but, per Nofumadores.org, has been stalled at the Ministry of Finance since October 2025. The competition authority CNMC said in April 2025 the cap 'does not correspond to market standards' and amounts to a de facto ban. (2) A bill amending Ley 28/2005, approved by the Council of Ministers on 21 July 2026 and sent to parliament, which bans consumption by minors and restricts sale of related products to specialised shops, while leaving pouches outside the smoke-free-space rules.

Tobacco snus in Spain
Banned for sale, legal to use.
Art. 25 of RD 579/2017 reads 'Se prohíbe la comercialización del tabaco de uso oral.' The ban on oral tobacco has applied in Spain since the 1990s under earlier EU directives; RD 579/2017 is the current basis. The ban covers placing on the market, not possession or personal use. GSTHR notes it is possible to import snus for personal use while import for trade or online purchase is illegal.
