Are snus and nicotine pouches legal in China?
China brought oral nicotine products inside the state tobacco monopoly on 9 January 2026. STMA Announcement No. 1 of 2026 defines smokeless tobacco products to include nicotine pouches, snus, chewing tobacco and snuff, and regulates them like cigarettes: production, import and retail need a monopoly licence, unlicensed production and sale are prohibited, and the sector is classed as a restricted industry. Before that the products sat in a grey area. Sale to anyone under 18 is banned. Travellers may bring 400 cigarettes, 20 cigars or 500 g of cut tobacco duty-free.

Nicotine pouches in China

The announcement covers 'tobacco products containing nicotine that are used orally, nasally, or externally without producing smoke, including nicotine pouches (patches, strips), snus, chewing tobacco, tobacco paste, dissolvable tobacco, and snuff'. Unlicensed production and sale are strictly prohibited and new investment in the sector needs approval under the restricted-industry policy. Chinese factories have been a major export source for pouches; the effect of the rules on export production is not yet clear. There is no established licensed domestic retail channel, so pouches are in practice not openly sold.
Tax: Smokeless products are administered like cigarettes and cut tobacco under the monopoly; no separate published excise rate found.
