Are snus and nicotine pouches legal in the United States?
Both tobacco snus and tobacco-free nicotine pouches are legal to sell and use in the United States for adults aged 21 or over, but every product needs FDA marketing authorisation. The FDA authorised 20 ZYN nicotine pouch products (3 mg and 6 mg) on 16 January 2025, the first pouches cleared through the premarket tobacco product application pathway, and renewed General Snus's modified-risk authorisation in November 2024. There is no federal nicotine cap or flavour ban, but California and Massachusetts ban flavoured oral nicotine and many states tax pouches. Travellers over 21 may bring a personal supply; the fixed duty-free limits cover cigarettes and cigars rather than snus.

Nicotine pouches in the United States

Nicotine pouches are 'tobacco products' under FDA jurisdiction because the nicotine is derived from tobacco, so each SKU needs a premarket tobacco product application (PMTA) order. ZYN 3 mg and 6 mg were authorised 16 January 2025 and later cleared for a reduced-risk claim; on! PLUS products followed. Thousands of other brands are sold without authorisation and are subject to FDA enforcement. California (Prop 31) and Massachusetts ban flavoured oral nicotine products; several cities have local flavour bans.
Tax: Nicotine pouches without tobacco are outside the federal tobacco excise schedule; states have been extending Other Tobacco Products taxes to them since 2023.

Tobacco snus in the United States

Swedish-style snus is legal smokeless tobacco. Eight General Snus products hold a renewed modified-risk tobacco product order (7 November 2024) allowing a reduced-risk claim; that renewal is the only MRTP renewal FDA has issued. Other snus brands need PMTA or grandfathered status. Warning labels for smokeless tobacco are mandatory. Some states restrict flavoured smokeless tobacco.
Tax: Snus is taxed federally as snuff and again by each state.

All tobacco and nicotine products must be declared on arrival. Commercial-scale quantities require an importer permit. Mail-order shipping of tobacco products into the US is heavily restricted by the PACT Act, which is why most foreign snus shops do not ship to US addresses.
