Snus vs nicotine pouches: why the law treats them differently
Tobacco snus is moist ground tobacco placed under the upper lip. Nicotine pouches are tobacco-free: a small bag of plant fibre, nicotine, flavour and salts. They are used the same way and often sold side by side in Sweden, but almost every legal system treats them as separate products. The EU bans snus and leaves pouches to national law; the UK bans snus and allows pouches; Australia bans both; Canada allows snus in tobacco shops but pouches only in pharmacies. Knowing which product you have is the first step to knowing whether it is legal.

How regulators classify them
Legal systems attach rules to categories, and the two products land in different ones.
- Tobacco product. Snus is a tobacco product everywhere. That triggers tobacco excise, health warnings, age limits, advertising bans and, in the EU and UK, the specific oral tobacco ban. Several countries (Sweden, Finland, Denmark, Estonia, the UK from 2026, the US) also treat pouches as tobacco or "tobacco-related" products by extending their tobacco acts.
- Novel food. Germany's federal and state food authorities decided that a pouch placed in the mouth and not smoked is a food, and that nicotine is not an authorised novel food ingredient. Result: sale is technically unlawful, possession is fine, and consumers order from abroad.
- Medicine or poison. Australia schedules nicotine as a poison unless in tobacco or a licensed therapeutic product, so pouches need a prescription. Japan treats tobacco-free pouches as pharmaceuticals requiring approval, while pouches containing tobacco are sold as tobacco.
- Own category. Sweden's Act on Tobacco-Free Nicotine Products (2022) created a dedicated category with its own age limit, warnings and tax. Poland, Czechia and others have followed a similar path.
- Banned as "imitation tobacco" or "novel product". Singapore, Thailand, the Netherlands, Belgium and France prohibit sale outright.
What it means in practice
- Buying. Check the two columns on any country page; one product can be legal and the other banned.
- Travelling. Customs officers may not distinguish the two. A can labelled "snus" that is actually tobacco-free can still be questioned in a country that bans oral tobacco; keep the packaging and ingredient list visible. See flying with nicotine pouches.
- Strength limits. Caps almost always target pouches, expressed per pouch or per gram. Snus is rarely capped. See nicotine limits.
- Tax. Snus carries tobacco excise everywhere it is legal. Pouch taxes are newer and patchier: Sweden, Denmark, Italy, Hungary and the UK (from 2026) have them; many countries do not yet.

Are nicotine pouches the same as snus?

Nicotine pouches. Tobacco snus is banned for sale across the EU (except Sweden), the UK, Australia and several other countries. Pouches are legal to sell in most of Europe, the US and many other markets, though a growing list of countries has banned them too.
Do the same age limits apply?
Usually the same age applies where both are regulated (18 in most of Europe, 21 in the US). In countries where pouches are unregulated there may be no legal age limit at all, although retailers often apply one voluntarily.
